Terms of Service
Manchikaa Terms and Conditions
Effective date: [Insert actual publication date]
Version: 1.0
These Terms govern access to Manchikaa at https://manchikaa.com and its related platform services. Manchikaa is a product of Take 3 Studios, operated by Ritesh Sharma trading as Take 3 Studios, Office No. 106, Spark Plaza, Ring Road No.1, Raipur, Chhattisgarh, 492005, India. GSTIN: 22CIZPS7078D1ZL. References to “Manchikaa”, “we”, “us” and “our” mean that operator.
“You” means an adult account holder, an authorised organisation representative, or a parent or lawful guardian managing a minor’s profile, as applicable. A “minor” means a person below 18 years for this policy. Section 8 contains additional child-safety conditions that prevail over conflicting general permissions.
1. Acceptance and related policies
Before creating an account, buying a subscription or submitting a listing, you must read and accept these Terms. Mere viewing of a public page does not authorise us to debit you or obtain optional marketing consent. Our Privacy Policy explains personal-data handling; the plan description and checkout summary explain the purchased services. Additional project agreements apply only to their parties and cannot override child-protection law or these platform safety rules.
The adult accepting these Terms must have legal capacity and authority to act. A minor does not become personally liable for an adult subscription or enter a binding production contract simply by clicking a button. Parents and guardians must not claim powers they do not lawfully possess.
Where these Terms conflict with mandatory law, that law prevails. Nothing removes consumer remedies, child-protection rights or duties to report unlawful activity.
2. Nature of the platform
Manchikaa is a creative-talent marketplace connecting performers and other creative professionals with casting directors, production houses and organisations seeking talent. Available functions may include profiles, portfolios, casting listings, applications, applicant tracking and subscription tools. Only features actually made available are offered; roadmap items are not included merely because they are described as planned.
Manchikaa does not guarantee employment, auditions, selection, earnings, a particular number of profile views or the commercial success of a project. A subscription purchases platform benefits, not a role or professional representation.
Unless separately agreed in writing, we are not a user’s employer, talent agent, production contractor, payroll provider or party to an engagement between users. If Take 3 Studios directly hires or commissions work, its responsibilities arise under that separate arrangement; the marketplace description does not exclude them.
3. Accounts and security
Provide accurate identity, age, contact and professional information. A playing-age range must not conceal the person’s actual minor status. Do not impersonate another person, falsify credits, use someone else’s portfolio, create accounts to evade restrictions or provide false company documents.
Keep passwords and verification codes confidential. Email/password and Google sign-in may be offered; mobile verification is an activation step and is not proof of identity, age, guardianship or professional standing. Never give an OTP or password to a caster, recruiter or purported support representative.
Use a mobile number you are entitled to verify. For a minor’s guardian-managed profile, use the responsible adult’s authorised contact details and the designated minor-profile process. If the interface cannot support that safely, contact us rather than registering the child as an adult or reusing another person’s verification.
Notify contact@manchikaa.com of suspected compromise. We may request proportionate checks, restrict a session or pause risky activity. Organisations must control access by their personnel and promptly remove unauthorised representatives.
4. Roles and approvals
Talent accounts may activate after required mobile verification. Caster and Production House accounts require manual platform approval in addition to verification. Approval may be requested again following material changes or safety concerns.
Approval indicates completion of our applicable review, not a guarantee of honesty, financial capacity, suitability, background clearance or government endorsement. Paid membership does not buy approval. Admin or staff roles are assigned separately and cannot be acquired through public signup or subscription purchase.
You may exercise only the permissions granted to your approved role. Do not use another role, an API or another account to bypass review, privacy settings or feature limits.
5. Talent profiles and applications
Upload only information and media you own or are authorised to use. Obtain permission from photographers, filmmakers, co-performers and other rights holders where required. Do not upload confidential scripts, unreleased footage, certificates containing unnecessary personal information or material taken from another artist.
State skills, credits, availability and work preferences honestly. Identify synthetic or materially altered portfolio material where it could mislead a hiring decision. Applications must relate to genuine opportunities; submission does not guarantee review or selection.
You control your visibility through available settings, subject to moderation. Public information may be viewed or copied outside Manchikaa. Do not publish home addresses, identity documents, financial details or children’s personal contact information. Previously downloaded copies and externally cached material cannot always be recalled.
6. Caster and production responsibilities
Post only genuine opportunities you are authorised to manage. Give clear project and role details, compensation or unpaid status, location, dates, audition method, eligibility, deadline, expected usage of recordings and any material travel or expense requirements.
Disclose material content and safety requirements before requesting an audition or commitment. Do not change a role to sexualised, hazardous, unpaid or materially different work after collecting applications without clear disclosure and fresh agreement. For minors, prohibited content remains prohibited regardless of consent.
Do not demand a security deposit, registration payment, mandatory paid portfolio package, course purchase or other fee as a condition of being considered or selected through a casting listing. Do not describe optional services as guaranteed access to a job. Any separately permitted training or service listing must be transparent and must not disguise pay-to-audition conduct.
Review applicant material only for the disclosed hiring purpose. Do not resell lists, harvest contact details, send unrelated marketing or share portfolios with unrelated recipients. Restrict access to authorised project personnel and retain unsuccessful applicants’ data only as reasonably needed and lawfully permitted.
Do not discriminate unlawfully. Any role-specific requirement must have a legitimate, proportionate basis. Do not require pregnancy tests, invasive examinations, sexual favours, private intimate images or access to personal accounts.
7. Engagements and professional conduct
Before work begins, parties should record compensation, payment dates, deliverables, working hours, expenses, safety arrangements, cancellation, credit, confidentiality and permitted media usage in an appropriate agreement. Agency representation must be disclosed and authorised. A manager’s claim does not replace a parent’s legal authority for a child.
Subscription payments to Manchikaa are separate from wages or project fees. Unless explicitly offered under a separate written service, we do not hold artist earnings in escrow, guarantee employer payment or administer project contracts.
Treat users respectfully. Harassment, stalking, coercion, threats, extortion, retaliation, fraudulent recruitment and sexual exploitation are prohibited on or off the platform when connected with its opportunities. A confidentiality agreement cannot prevent lawful reporting of abuse.
8. Minors and parents or lawful guardians
8.1 Adult-managed participation
A minor may be represented only through a responsible parent or lawful guardian aged 18 or above, whose identity and authority can be checked. The adult must manage purchases, applications, communications and decisions. A child must not independently operate a hiring account or be described as an adult to access adult opportunities.
Basic access, public profile display and optional promotional display are separate decisions. No child profile may be published or submitted to a project until the relevant authority and permissions have been established. If a required control is unavailable, that use must remain restricted; these Terms are not a substitute for the control.
8.2 Age and guardianship checks
The parent must provide the child’s accurate age and their genuine relationship or lawful authority. We may request age or guardianship evidence proportionate to the risk. Verification material must be supplied only through the designated private process, never in a public portfolio or to an unknown recruiter.
Do not assume that verifying an adult’s phone establishes parenthood. A guardian dispute, inconsistent evidence, court restriction or uncertainty about authority may result in a profile being made private or paused until resolved. We do not decide custody disputes.
8.3 Specific consent and the child’s wishes
The adult must receive and understand the relevant notice and choose separately whether to authorise: account/profile administration; public display of selected media; submission to a named project; and optional homepage spotlight or other promotion.
Buying Elite, accepting these Terms or enabling a profile does not automatically consent to every publicity use, future production or third-party download. Consent cannot authorise unlawful or harmful activity. The child’s views, comfort, age and understanding must be respected; distress or refusal is a reason to stop, not to pressure the child.
8.4 Public visibility and Featured Talent
A minor’s information must be minimised. Do not publish full birth date, school, home address, precise location, routine, travel itinerary, direct personal contact details or guardian verification material. Public minor spotlight cards must not display location.
Spotlight is optional and requires the applicable guardian consent, eligible membership, public-profile choice and content/photo review. It rotates; inclusion or a paid tier is not a professional endorsement and does not guarantee exposure or selection. A photo change may require new approval.
Guardian documents and confidential review notes are not public profile content. Child-profile media must not be reused in unrelated advertising, social campaigns or external promotion without separate, purpose-specific permission.
8.5 Contact and auditions
Recruiters must communicate with the responsible adult rather than privately approaching the child. Never ask a child to keep contact secret, use disappearing messages, travel alone, conceal a meeting or exclude the guardian from an audition or production discussion.
Before an audition, the guardian should obtain the organiser’s identity, project description, exact venue, responsible on-site adult, audition requirements and recording policy. Auditions must occur in an appropriate professional environment with adult supervision. For online auditions, the guardian must be able to supervise; recording requires specific advance permission.
No private hotel-bedroom auditions, undressing requests, sexualised self-tapes, intimate photographs, secret meetings or isolated one-to-one sessions involving a child are permitted. Do not publish audition recordings or use them commercially without an appropriate separate agreement and lawful authorisation.
8.6 Permits and production safeguards
The producer or organiser must establish that the engagement is lawful for the child’s age, obtain applicable permissions and comply with relevant child-labour, education, safety and entertainment safeguards. Parent consent alone is not a work permit.
Requirements may include District Magistrate permission or undertakings, limits on work and continuous work, rest, schooling, supervision, welfare personnel, transport, safe facilities and protection of earnings. Apply the correct age-specific requirements and relevant NCPCR guidance rather than assuming one schedule suits every person below 18.
For every project, the hiring party must give the guardian its written safeguarding arrangements before participation. Where required, provide evidence of permissions and lawful arrangements for protected earnings. Manchikaa approval does not certify a production’s compliance or transfer those duties away from the employer.
8.7 Content and physical safety
Children must not be used for sexualised performances, nudity, exploitative imagery, humiliating material, hazardous work or unsafe stunts. Do not require inappropriate touching, substance use, distressing conduct or simulated abuse without lawful, specialist-reviewed safeguards; prohibited activity remains prohibited even if a parent agrees.
Provide age-appropriate costumes, changing arrangements, rest, food, water and necessary medical support. Respect disability-related needs and dignity. The guardian must be able to raise concerns and remove the child from unsafe conditions without threats or coercion.
8.8 Education, earnings and contracts
Participation must not unlawfully interfere with education or development. Parties must accommodate applicable schooling and examination requirements. The guardian must review proposed hours and travel before acceptance.
Specify fees, protected earnings arrangements, expenses and payment dates in writing. A parent or manager must not misappropriate a child’s earnings. Hiring parties remain responsible for any legally required deposits or payment protections.
A guardian’s acceptance of these platform Terms is not a blanket assignment of the child’s image rights, earnings or future services. Any production agreement requires separate lawful review and project-specific authority; nothing here cures an otherwise unenforceable agreement with a minor.
8.9 Withdrawal and attaining adulthood
A guardian may withdraw optional spotlight/publication consent through available privacy controls or contact@manchikaa.com, including when a subscription has expired or the account cannot be accessed. Withdrawal must not depend on buying or renewing a plan. New platform responses must respect the resulting restriction after it is processed; previously displayed, downloaded or independently retained material may require separate removal requests.
Withdrawal can prevent further submissions or promotion and may require restricting the profile. It does not automatically erase legally retained payment or safety records, undo lawful past processing or terminate a separate production contract. Safety concerns should be raised immediately regardless of any project disagreement.
When the child turns 18, account control, consent and visibility must be reviewed with the now-adult user. We may pause promotion while completing that transition. A parent must not retain control without the adult user’s valid authority.
8.10 Safeguarding reports
Report suspected grooming, exploitation, abuse, trafficking or dangerous recruitment promptly. Preserve ordinary relevant messages and identifiers safely, but do not download, forward or attach suspected child sexual abuse material. Report where it is located instead.
An internal complaint does not replace reporting to police or other competent authorities. Nothing requires mediation, secrecy, a prior platform decision or guardian approval before a child seeks help. Where a guardian may be implicated, a child may approach another trusted adult or authorities directly. We may preserve evidence and disclose information as required or permitted by law.
9. User content and intellectual property
You retain rights you lawfully own in your portfolio and other submissions. You grant us a non-exclusive licence, limited to operating the selected services, to host, securely process, resize, display and deliver that content in accordance with your visibility choices and authorised applications. Service providers may process it only for those purposes under appropriate arrangements.
This licence does not authorise us or recruiters to sell your likeness, create an AI clone, train a general-purpose model on your portfolio or use your media in unrelated advertisements. Separate permission and legal rights are required for those uses. For a child, additional guardian safeguards apply.
When you delete content or restrict visibility, active display must reflect that choice, subject to reasonable processing, backups, legal retention and necessary records of previous authorised submissions. Those exceptions do not permit continued unrelated promotion.
Manchikaa branding, software and site design remain our or our licensors’ property. Do not copy the service, scrape profiles, bypass access controls or remove ownership notices. A PDF talent card is for the user’s legitimate professional promotion, not permission to misrepresent others.
10. Prohibited uses
You must not use the platform for scams, fake projects, impersonation, unlawful discrimination, sexual exploitation, hate, threats, unlawful surveillance, intellectual-property infringement, malware, credential theft or unauthorised data extraction. Do not upload another person’s confidential information, deepfake pornography or manipulated identity evidence.
Do not sell accounts, evade bans, automate bulk applications or exploit pricing, credit, payment or quota errors. Do not manipulate spotlight statistics, create false reviews or claim a platform affiliation you do not possess. Access restrictions also apply to APIs and downloaded data.
11. Subscriptions and included features
Free and paid plans have the benefits and limits shown at purchase. Paid features may include additional application allowances, profile analytics, a downloadable talent card and eligibility for rotating Featured Talent display. A feature described as a roadmap item is excluded until expressly made available.
Plans are prepaid and renew manually unless a separately offered recurring service is expressly selected and authorised. A saved payment method or an earlier purchase does not authorise future automatic charges. Payment processing is provided through the displayed payment provider; we do not request your card PIN or OTP.
Existing purchases retain their recorded price, period and promised benefits. Future prices may change with disclosure before a new purchase. We may improve features, but a material reduction of purchased benefits will be addressed through appropriate alternatives or remedies required by law.
Application and other quotas use their stated measurement periods. Upgrading may increase a limit without resetting usage already consumed. On expiry, access returns to the applicable free tier. We retain records rather than deleting a portfolio solely because it exceeds a lower tier’s limit; further additions may be restricted.
12. Payments and activation
The checkout summary specifies the plan, duration, start rule, base fee, taxes, credits and amount payable. Check it before authorising payment. Only server-confirmed qualifying payments or valid credit settlement activate a paid entitlement.
Payment confirmation may arrive after checkout closes. Closing the window does not necessarily cancel a completed bank payment. Check Billing or contact billing@manchikaa.com before paying again. Duplicate notifications do not create multiple periods for one purchase. Unexpected or duplicate captured payments require reconciliation and an appropriate resolution.
We may temporarily hold an inconsistent transaction for review, but will not silently retain payment without the corresponding service or remedy. Your bank or payment provider may impose its own processing or refund timelines.
13. Upgrades, renewal and subscription credit
For an eligible immediate upgrade, the checkout shows the unused value credited from the current purchase and the price of the replacement period. The new period begins as stated after fulfilment. The replaced period does not also contribute extra validity when its unused value has already been transferred as credit.
Credit uses the original eligible funded value and purchased duration, excluding used, refunded or previously transferred value. Calendar-period purchases and historical fixed-day purchases may use different disclosed proration methods. The quote must identify the calculation and any tax treatment before payment.
Subscription credit is restricted to the account, cannot be sold or transferred, and is not withdrawable cash except where mandatory law requires a remedy. It may settle eligible future purchases; it is not automatically a tax-reducing discount. Available credit must not be charged or consumed twice.
Renewing the same active plan normally adds a period after its current end. A lower plan selected for the next period takes effect on the displayed future date. If that change requires prepayment, checkout must state this clearly. Failed renewal does not remove time already paid for.
14. Taxes and billing documents
Displayed base fees are exclusive of applicable GST where so stated. The checkout shows the tax-inclusive payable amount. Domestic GST components depend on the established place of supply: applicable intrastate CGST/SGST or interstate IGST. Exceptional cases may require billing support rather than ordinary checkout.
Provide accurate billing details. Eligible hiring-company accounts may supply business GST details through the designated process. Invoice availability does not guarantee the recipient’s input tax credit. Do not supply another entity’s GSTIN or request false/backdated invoices.
Issued documents record the transaction’s accepted details. Later profile edits do not rewrite them. Corrections, refunds and tax adjustments follow an appropriate documented process. Invoices, payment receipts and advance vouchers serve different purposes. Historical purchases are not retrospectively repriced merely because the billing system changes.
15. Cancellation, refunds and payment disputes
Manual prepaid plans do not create an automatic mandate to cancel. You may choose not to renew. Deleting an account does not itself request or guarantee a refund.
A voluntary change of mind or failure to obtain work does not automatically create a prorated cash-refund entitlement. However, this is not an absolute no-refund clause: applicable consumer rights and remedies for duplicate charges, non-delivery, material defects, misrepresentation or unlawful terms remain available.
Contact billing@manchikaa.com with the payment reference and issue. We will investigate and explain the resolution. Approved refunds are processed through the appropriate payment route where feasible. Refunds and chargebacks may require proportionate adjustment of the benefits or credit they funded, without removing unrelated paid access. Do not seek double recovery through both a refund and retained transferred credit.
No separate refund policy may reduce mandatory statutory rights. Any additional refund conditions must be shown before purchase and be consistent with these Terms.
16. Featured Talent and analytics
Featuring requires eligible membership and applicable quality, privacy, consent and moderation conditions. Paid eligibility is not guaranteed permanent placement. Publicly identifying a profile as Featured must not imply verified credentials or endorsement of suitability for a role.
Analytics are estimates derived from measured events; a showreel-link click is not proof of a completed video view. We do not guarantee perfect bot filtering or disclose individual visitor identities to talent. Child-related measurement must be limited and reviewed separately; parental consent is not blanket permission for behavioural profiling or advertising directed at children.
17. Communications and third-party services
We send essential account, moderation and billing communications to the relevant registered or billing contact, using service providers. Billing messages may come from billing@manchikaa.com and other messages from contact@manchikaa.com. Check spam folders and keep contact details current. Marketing permission, where required, is separate and can be withdrawn without disabling essential service notices.
Third-party payment, storage, sign-in, mail and SMS services may have outages or their own terms. We remain responsible for our own obligations and do not treat a vendor disclaimer as a waiver of your rights. External links and off-platform communications may have different privacy practices.
18. Privacy and personal-data requests
Read the Privacy Policy for data categories, purposes, providers, retention, security and available rights. These Terms do not replace a clear privacy notice or specific consent. We request only proportionate verification material and must not publish it as portfolio content.
You may ask to access, correct or delete your information or withdraw optional consent through contact@manchikaa.com and available controls. Requests may require proportionate identity checks. Some accounting, fraud-prevention, legal-claim and child-safety records may need to be retained with restricted access.
Applicable Indian privacy duties, including phased provisions of the Digital Personal Data Protection Act and Rules as they commence, prevail. No general acceptance of these Terms waives statutory data rights or authorises prohibited child-data processing.
19. Moderation, complaints and safeguarding
We may review reported material, remove listings, restrict access, request evidence or suspend accounts for credible safety, fraud, legal or policy concerns. We may act urgently where prior notice risks harm or evidence loss. Where lawful and appropriate, we explain the action and provide an opportunity to challenge an error.
Report content or conduct through available reporting controls or contact@manchikaa.com. Give the relevant profile/listing URL, a factual description and safe supporting evidence. Do not attach unlawful sexual imagery, unnecessary identity documents or payment credentials.
Complaints involving children receive safeguarding priority. We may refer matters to competent authorities and preserve relevant records. We do not promise absolute confidentiality where disclosure is legally required. We will not require users to settle abuse allegations privately as a condition of reviewing them.
Formal grievance contact: Adv Sankalp Roy at contact@manchikaa.com Complaints and lawful requests are handled within applicable statutory timelines.
20. Suspension and account closure
You may request closure through support or available controls. We may restrict or close accounts for material breach, false age/authority, repeated scams, unlawful content, security risk or a legal requirement. Restrictions apply notwithstanding a paid plan.
We will consider a proportionate resolution for unused purchased service where appropriate and required by law; suspension is not an automatic entitlement to confiscate every payment. Necessary complaint, payment and legal records may survive closure. Closing an account does not erase obligations lawfully incurred or prevent safeguarding reports.
21. Availability and reasonable limitations
We maintain the platform with reasonable care but cannot promise uninterrupted operation or error-free third-party content. Users should independently evaluate projects, contracts and venues. We do not guarantee that every harmful user or inaccurate statement will be detected.
These limitations do not exclude responsibility for our own fraud, wilful misconduct, negligence causing harm where liability cannot lawfully be excluded, statutory consumer remedies, applicable data duties or child-safeguarding obligations.
For business users acting outside consumer protections, and only to the extent lawful, liability for ordinary direct contractual loss is limited to the greater of INR 1,000 or the platform fees paid by that business for the affected service during the preceding twelve months. This limit does not apply to liability that law prevents us from limiting. No child is asked to accept a liability cap or indemnity by using a profile.
22. Responsibility for unlawful submissions
An adult business user may be responsible for third-party claims directly caused by its fraudulent listings, unlawful content, infringement or unauthorised disclosure. Any indemnity is limited to attributable loss, subject to lawful defences and reasonable participation in the defence. It does not cover Manchikaa’s own wrongdoing, impose a blanket parental guarantee or make a minor liable for adult misconduct.
23. Changes to these Terms
We publish the version and effective date of material changes and provide appropriate notice. Changes are not used to rewrite completed purchases, expand an existing image licence retrospectively or convert manual renewal into automatic charging. Where fresh agreement or consent is needed, we will seek it. Child-related optional consent remains separately withdrawable.
24. Governing law and dispute resolution
Indian law governs these Terms. Contact us first where practical so we can investigate, but this is not a prerequisite to approaching police, regulators, child-protection authorities or a forum competent under mandatory law.
Subject to statutory jurisdiction and consumer protections, courts with competent jurisdiction in Raipur, Chhattisgarh may hear ordinary contractual disputes. Nothing requires a consumer to surrender a competent local forum or obliges a child to arbitrate a safeguarding complaint. We do not impose mandatory private arbitration through these Terms.
